RESIDENTS ARE REQUIRED TO ADHERE TO ALL RULES & REGULATIONS POSTED AT THE SPORTS COURTS, SWIMMING POOL, AND PARKING LOT. THE COMMON AREA CLOSES AT 10:00 PM DAILY. NO OVERNIGHT PARKING IS ALLOWED. UNATTENDED VEHICLES WILL BE TOWED AT OWNERS EXPENSE.

2014 Pool Rules & Guidelines

The safety and enjoyment of the members of the community are of primary concern in the operation of our pool. If we show courtesy and consideration for others in our use of the pool, only a minimum of rules and guidelines should be needed. This is YOUR swimming pool. For your maximum enjoyment and safety, experience has shown that certain rules are necessary.

Schedule & Hours of Operation:
Pool Opens and Closes for the season according to the outside temperature
Pool Hours: 10:00 am to 10:00 pm (5:00 am to 9:00 am for Lap Swimming Only)
The Association reserves the right to close the pool at any time for emergencies, weather or repair purposes.

Entry & Pool Use:
NO LIFEGUARD ON DUTY, USE POOL AT YOUR OWN RISK
An electronic card is needed to access the facility. Cards may be obtained from the Spectrum offices located at the address above. A waiver must be signed prior to issuance of a pool card.
Big Springs Owners Association assumes no responsibility for accidents, personal injury or lost articles. Way Bright Pools and Board of Directors are in charge of pool operation and responsible for enforcement of the rules.
The pool facilities were designed and built for the primary use and recreation of residents, their visiting relatives and guests.
Only Association Members in good standing (i.e. current on HOA assessments), their tenants and their accompanied guests are permitted to use the pool and pool area.
Pool Rental:
The pool is not available for private parties and is open to all members during regular posted pool hours only. Guests:
Only members in good standing may bring guests to the pool. The host member is responsible for his/her guest’s conduct at all times and must accompany their guests at all times.
The Board of Directors may limit the number of guests or request guests to leave the pool in matters concerning safety or overcrowding.
A GUEST CANNOT BE A NON-PAID MEMBER OF THE BIG SPRINGS COMMUNITY, I.E. BIG SPRINGS MEMBERS WHO HAVE NOT PAID THEIR ASSESSMENTS. THESE MEMBERS MAY NOT ENTER THE POOL OR POOL AREA AS A GUEST OF A PAID MEMBER.
 
Pool Conduct/General Rules:
  • The Board of Directors is in charge of pool operation and responsible for enforcement of the rules.
  • An adult seventeen (17) or older must accompany children under the age of ten (10).
  • No children under the age of two (2) are allowed in the pool at anytime without appropriate swim/pool diaper.
  • Persons with infectious diseases or open wounds are not allowed in the pool. (Chicken pox, poison ivy, etc.)
  • Pool play equipment is not allowed.
  • HORSEPLAY, RUNNING, DUNKING, PUSHING, UNDUE SPLASHING, ABUSING POOL EQUIPMENT, SPITTING AND/OR THROWING OBJECTS ARE NOT ALLOWED. Persons engaging in these activities will be told to leave.
  • No food, glass containers, gum chewing or smoking permitted on pool edges or in pool. Foods, drinks, etc. will be permitted only in designated areas, and only in unbreakable containers.
  • No glass face masks or goggles will be allowed in the pool. Floating devices attached to swimmer for safety are allowed only in the shallow end.
  • Use of skates, skateboards, bikes, roller blades, and similar devices are prohibited in the pool enclosure.
  • Animals are not allowed in the pool enclosure except for seeing-eye dogs.
  • Please report all injuries immediately to Spectrum Association Management at (210) 494-0659.
  • Proper swim attire only, no t-shirts, shorts or cutoffs are permissible.
  • Pool operating hours must be strictly adhered to.
  • Parents assume all responsibility for their children.
  • Any person expelled from the pool area three (3) times will be suspended automatically from use of the pool facilities for one (1) week.
  • No person who is under the influence of drugs or alcohol is permitted in the facility or pool and/or the pool area.
  • To prevent/avoid chemical imbalance in the pool, please:
  • Towel or shower off suntan lotion or oil before entering the pool (oil gums up the tiles and dilutes the chemicals).
  • If hair is longer than shoulder length, braid or confine in a pony tail or bun, or wear a bathing cap (loose hair cannot be back washed from the filtration system and reduces its efficiency).

Tennis & Basketball Court Conduct/General Rules:
 
  • The tennis and basketball courts are for the use of members and their guests. Members must accompany their guests on the courts. The courts are to be used for BASKETBALL & TENNIS ONLY.
  • Only members in good standing may bring guests to the sports courts and/or playground.
  • The host member is responsible for his/her guests conduct at all times and must accompany the guest at all times.
  • Proper tennis attire must be worn at all times. Only soft soled, court style tennis shoes are allowed on the courts. No hard soled or cleated shoes are allowed.
  • Please refrain from using foul language on the courts.
  • No cigarettes, glass containers, gum or food items are allowed on the courts. Please deposit trash in the containers provided.
  • Non-tennis playing, unattended young children should not be on the tennis courts.
  • Please close the gate if you are the last person leaving the court.
  • Play will be limited to 45 minutes when others are waiting. Those waiting will take the next available court.
  • Do not lean or hang on the tennis or basketball nets.
  • Use of skates, skateboards, roller blades, bicycles and/or similar devices are prohibited on the courts.
  • Climbing the fences for any reason is not allowed.
  • A GUEST CANNOT BE A NON-PAID MEMBER OF BIG SPRINGS, I.E. BIG SPRINGS RESIDENTS WHO HAVE NOT PAID THEIR ASSESSMENTS. THESE RESIDENTS MAY NOT ENTER THE TENNIS & BASKETBALL AS A GUEST OF A PAID MEMBER.
  • No person who is under the influence of drugs or alcohol is permitted to use the facilities.
Big Springs Owners Association is not responsible for accidents, personal injury or lost/damaged or stolen articles.
Rule violations should be reported to Spectrum Association Management. Anyone guilty of repeated violations of the posted rules can be temporarily or permanently barred from use of the recreational facilities by order of the Board of Directors.
If any equipment is faulty or in need of repair, please contact Spectrum Association Management at (210) 494-0659. PLEASE REMOVE YOUR TRASH WHEN YOU LEAVE.
THE BOARD OF DIRECTORS MAY AMEND OR CHANGE THESE RULES AT ANY TIME.
RECREATIONAL FACILITIES ARE OWNED BY THE BIG SPRINGS OWNERS ASSOCIATION, INC.

RESERVATIONS
 
Reservations may be made through Spectrum Association Management by calling 877-269-9092 or at the address above, Monday thru Friday 9am – 5pm (except for holidays). 
 
Only Members of Big Springs Owners Association in good standing may rent the facilities.
Reservations may not be made more than 90 days in advance of the desired dates.
          
A $200.00 deposit is required at the time reservations are made.
The deposit will be refunded after the facility has been inspected by Spectrum Association Management or an authorized Board member if no damage(s) are found. In the event of damage, necessary repairs or replacement will be made. Any remaining funds will be refunded to the individual. Should repairs or replacement exceed the deposit, the leasing member will be billed for additional expenses.

 If function is not cancelled 48 hours prior to event, resident will forfeit 50% of the rental.
 
Association Member must be present at all times during the event.
  
Rental Fees: (initial by your selection)
 
Clubhouse 
$100.00:    Rental fee is Non-refundable and must be paid in full two weeks prior to rental date.
           
Function cannot exceed 60 people.  Pool use not included in clubhouse rental but can be for an additional $50.00 (not to exceed 20 swimmers)
 
Swimming Pool
$25.00:   Rental fee is Non-refundable and must be paid in full two weeks prior to rental date.
 
A $50.00 deposit is required at the time reservations are made.
  
Function cannot exceed 20 swimmers.  May NOT be used for business events/office parties.     
The pavilion cannot be used and must remain accessible to other Big Springs residents at all times 
Picnic Area(s)
Allowable for use at no charge but must be reserved through Spectrum Association Management.
 
Function cannot exceed 30 people.  May NOT be used for business events/office parties.   
The pavilion cannot be used and must remain accessible to other Big Springs residents at all times
 
 
AT NO TIME, regardless what area has been reserved or how much a resident has paid, shall a resident or party commandeer all quadrants of the common area.
 
 
ALL Big Springs residents should have access to and feel welcome at the facilities without interference from any pre-approved parties.
 
 Payments:
 
Payment must be made by check or money order. (Payable to Big Springs Owners Association)
Submit all fees on one (1) check or money order (Checks MUST be from leasing Member’s account)
 
All checks will be deposited. (Checks will not be “held” and returned to member)
I understand that any deposit returned to me will be in form of a check from the Association mailed to my home address and that the refund process may take up to 45 days.
 
Keys to Facilities:
Keys to access the Clubhouse will be available on the day of your event from the Cactus Bluff Guard House.
 
Pick Up/Return Times depend on your designated event time:
12:00PM -5:00PM Pick up key no sooner than 10:00AM
Return key to guardhouse no later 5:15
6:00PM -11:00PM Pick up key at 6:00PM
 Return key to guardhouse no later than 11:15PM
  
RULES FOR USE
 
The Recreation Facility will remain closed while not in scheduled use.
Rental of the Clubhouse does NOT include use of the pavilion or swimming pool.
It is to remain open at all times to allow all Big Springs residents unencumbered access to their facilities.
 
 
  • NO persons with wet feet or wet clothing are permitted in the recreation facility
  • NO SMOKING is allowed inside or outside of the building for both safety and comfort to others.
  • NO dogs, pets, or farm animals are allowed in the recreation area.
  • NO one under 18 years of age will be allowed to use the recreation facility unless accompanied by an adult resident of Big Springs.
  • NO alcoholic beverages can be served to minors on Big Springs Owners Association property. 
  • NO thumbtacks, push pins, scotch tape, staples, nails, etc are to be used on any of the clubhouse walls.
  • Decorations must be approved in advance by the Managing Agent.  Decorations should only be hung from the “cork pads” or hooks that are provided. All approved decorations must be removed by the member before leaving the facility. 
  • NO DJ allowed in clubhouse. ALL doors are to remain closed when playing music.
  • The maximum allowable rental time period is 5 hours total.
  • Beer kegs must be in containers that prevent water from standing on the floor and patio areas.
  • Member must provide guardhouse with a guest list within 24 hours of the function. List may be updated. 
  • Sixty (60) is the maximum number of people that the Clubhouse can accommodate. Any group exceeding that number will automatically forfeit the $200.00 damage deposit and may lose the privilege to reserve the Clubhouse permanently.
  • Parties must end and the facility must be vacated by your designated event time (5:00PM or 11:00PM).
  • Failure to vacate the premises in a timely manner can result in forfeiture of the member’s deposit. 
  • ALL FUNCTIONS that include more than a resident’s immediate family MUST be set up through Spectrum Association Management. 
  • Repeated, excessive noise complaints can result in forfeiture of deposit. The Big Springs Security Patrol will warn the residents when the noise is unacceptable. 
  •  Parking only allowed in designated spaces.  Do not block any driveways, roadways or access to sidewalks.
 
 
 
CLEANING/EXIT CHECKLIST
Cleaning of the recreation facility must be completed immediately after use. 
Floors swept and mopped (cleaning supplies placed back in elevator where found).
  
All counter tops, sinks, & stainless steel towel holders wiped with cleanser.
 
 
Tables (5) used during the function placed back by the entrance door (where found).
Chairs (40) stacked 10 high and placed in front of the kitchenette doors (where found).
  
Doors- (4) glass doors locked & entrance door locked from knob and by dead bolt.
  
Air Condition set to 78 degrees and cover replaced and locked. (Heater set to 70 degrees)
  
Lights turned off (switch is on wall by thermostat).
  
Ceiling fans turned off (switch is on wall by thermostat).
 
Trash removed from the premises and taken to the members’ residence (there is no trash pickup available).
Trash removed from the trash can provided and new bag put in its place.
Trash removed from the bathroom receptacles and new bag put in its place.
 
All personal property  (punch bowls, coffee pots, kegs, food, beverages, ice chests, etc.) removed from the facility. Storage of such property at the facility may only be done with Managing Agent’s approval and solely at the Member’s own risk.
 
The Board of Directors and Spectrum Association Management, LP reserve the right to check on the use of the facility and determine if the rental is in accordance with the rental agreement.

HOLD HARMLESS AGREEMENT
     By signing below you agree to the following hold harmless agreement and legal contract:
 
Renters shall be fully responsible for all activities occurring in the recreation facility during the rental period and shall hold the Big Springs Owners Association, Inc., and Spectrum Association Management, LP, and its agents free and harmless of any damage or loss of personal property or any bodily injury suffered for any reason during or as a result of a rental. By signing this agreement you acknowledge and understand that you are personally responsible for any damage or injury to yourself or any individual present on the Association’s property.  You further understand that your period of responsibility begins once any member of your party enters the property and/or once your rental time starts, whichever comes first, and does not end until you and all your guests have left the Association’s property.  You also acknowledge and understand that if you serve alcohol you are completely responsible for any action or inaction, which is caused as a result of serving alcohol.  If a person at your rental causes any damage to property, and/or bodily injury, and/or harm to him/her self and/or any other person, while located on or off the Association’s property during or following your rental as a result of consumption of alcohol at your rental, you understand that you assume full and total responsibility for their actions and agree to hold the Big Springs Owners Association, Inc. and Spectrum Association Management, LP harmless.
 
Member, by his/her signature below, agrees that the liquidated damages to Big Springs Owners Association are satisfied by full forfeiture of rental deposit.
 
Should repairs or replacement exceed the deposit, the leasing member will be billed for additional expenses.
 
If, in the judgment of Managing Agent, the building and/or grounds are not properly cleaned up, a clean-up fee of $50.00 per hour will be charged and deducted from the Member’s rental deposit.
 
Members who violate this rental agreement may be subject to suspension of the recreation facilities, rights and privileges.
